His Majesty's Government cannot give their sanction to the supposition that unauthorized encroachments by private persons upon public property confer upon them a title of occupation which prevails against the rights of the Crown and the public convenience, though the particular circumstances under which those encroachments have taken place may create a claim to lenient treatment on the part of the local Government.
